Jakubowski Pluta and Partners law firm was established in 1993.

We have extensive experience in handling cases involving copyrights, press law and the media, advertising and protection of personal rights, including the use of a person’s image for commercial purposes.

Jakubowski Pluta i Wspólnicy Kancelaria Radców Prawnych Sp. P. has existed since 1993.

Our law firm provides legal assistance within the scope of the broadly defined commercial law. Our clients include foreign enterprises, Polish companies and one-man enterprises.

Our law firm is a part of the Consilium Iuris, a European Economic Interest Grouping which brings together layers, tax advisors and auditors; we are also a member of  ISUFUL European Legal Network – an international network of law firms.

In the years 2009-2012 our firm was listed among the law firms recommended by the prestigious The Legal 500 publication with respect to intellectual property rights.

Janusz Jakubowski and Krzysztof Pluta

We offer comprehensive legal assistance in the area of commercial law.

We have extensive experience in handling cases involving copyrights, press law and the media, advertising and protection of personal rights, including the use of a person’s image for commercial purposes.
We guarantee not only legal assistance in specific cases, but also comprehensive, constant legal service related to running a company or the business activity conducted.

Our clients are offered legal assistance in the form of legal advice and consultations, written legal opinions, explanations concerning application of law, drawing up of documents, as well as representation before courts, administration authorities and other persons.

Over twenty years of collaboration with composers and artists, their managers, and also with promoters and organisers of festivals, concerts and shows, with audio-video producers and music publishers have allowed us to gain much experience in the areas in which the copyright law meets the modern market of cultural goods and services and the trading practice.

Collective management of copyrights and related rights, so important not only to the composers and artists, but also to the entrepreneurs using their works and other items protected by the intellectual property rights, is also an important element of our practice.

Our knowledge of the copyright law and the experience obtained are used when drafting agreements, providing advice and legal opinions, and in our frequent court appearances, which are an important part of our professional activity.

For well over 20 years now we have been providing legal assistance to key printed and online press publishers. In the past we also gained experience in working with radio broadcasters. We provide legal assistance in cases concerning registration of press titles, cases related to editorial activities and in particular those pertaining to the freedom of expression, press release corrections, publication of advertisements and claims arising from press or other activity consisting in publishing information or artistic works, e.g. online.

We offer legal assistance supported by many years of experience gained in collaboration with press publishers, well-knownpersons and advertising agencies regarding the freedom of expression in the press, freedom of artistic expression, protection of reputation, the right to privacy, protection of personal image, commercial use of the person’s name and of the image in an advertising campaign.

Advertising is a branch of business that constitutes a special challenge to lawyers. It requires knowledge and experience related not only to the copyright law, the press law, the personal rights protection law, but also the personal data protection law, the unfair competition law, the consumer law, and numerous other regulations spread in various normative acts, such as the pharmaceutical law or the act on upbringing in sobriety and alcoholism prevention.

Many years of collaboration with advertising agencies and their contractors have allowed us to recognise the needs of the advertising market and gain valuable experience enabling us to avoid many traps and risks related to the advertising and promotional activities.

Apart from drafting agreements on the provision of advertising services and media support or agreements essential for proper and secure running of advertising campaigns, we also draft rules for competitions and promotional lotteries, premium sales programmes, and we also provide assistance in applying for permits to carry out promotional lotteries.

We offer legal assistance in civil and commercial cases, through representation of clients in litigation before common courts of law and before the Supreme Court. We have experience in handling court trials, and in particular those pertaining to the protection of personal rights, copyrights, publication of press release corrections and cases related to ongoing business activity: agreements for provision of services, specific task contracts, lease agreements etc., and also labour law cases.

While working with our clients we not only assist them in meeting correctly the formal requirements when starting a business activity, but also, relying on our long-term experience, we help them to select the organisational and legal form of the company that will best match the specified type and scale of the activity planned and, in the case of companies, to correctly regulate the internal relationships between partners. In the course of our clients’ business activity we advise and assist them in the correct performance of their duties stipulated in the Code of commercial companies and the act on freedom of business activity.
We also have significant experience and we offer our services in creating foundations and associations, running them and helping to meet the statutory obligations.
