Jakubowski Pluta i Wspólnicy Law office has existed since 1992.

The law firm provides legal services in the field of economic law, in particular to entities connected with the arts, media, press, publishing and Internet industries. We assist entrepreneurs, starting from advising on the choice of the legal form of running a business, through the process of establishing a company, association or foundation, to preparation of all necessary contracts, documents, applications and completion of procedures related to running a business (including creating websites, e-commerce, GDPR matters).

We provide legal services required on an everyday basis to purse business, including ongoing advice, conducting trainings, business negotiations and court disputes. Depending on the circumstances and needs of the client, we provide our services in our office or in other locations.

Thanks to many years of trust-based relationships with our clients, we can mutually develop and exchange valuable experience. Over the years, we have had the pleasure and honour to serve and advise entities that co-created today’s artistic and publishing market. In addition to legal knowledge, one of our greatest assets is well-established experience and familiarity with the market.

Among our clients there are foreign entities, Polish companies and sole proprietors, artists, journalists and other persons pursuing creative activity.

Copyright, music, film, artistic activities

More than thirty years of cooperation with creators and artists and their managers, promoters and organizers of festivals, concerts and shows, as well as audio-video producers and music publishers, has allowed us to gain extensive experience in areas where copyright encounters the modern market of goods and culture services as well as business practice. The issue of collective management of copyright and related rights, which is of utmost importance to many creators and artists, but also to entrepreneurs who use works and other objects protected as intellectual property, also represents an important area of our practice. We employ the knowledge in the field of copyright law and the experience gained when drafting contracts, providing legal advice and opinions, and in extensive litigation practice, which is an important area of our professional activity.

Press law, media, advertising

For over thirty years, we have been providing legal assistance to leading publishers of the printed and online press. In previous years, we also gained experience in servicing radio broadcasters. We provide legal assistance in matters relating to the registration of press titles, issues pertaining to the activities of the editorial office, in particular regarding freedom of expression, press corrections, publication of advertisements and claims that may arise in connection with press activity or other activity consisting in publishing information or artistic creations, for example online. Advertising is an area of business that poses a particular challenge for a lawyer. It requires knowledge and experience not only in the field of copyright law, press law, protection of personal rights, but also personal data protection, combating unfair competition, consumer law and a number of regulations scattered in various normative acts, such as pharmaceutical law or the Act on Upbringing in Sobriety and Counteracting Alcoholism. Over twenty years of cooperation with advertising agencies and their contractors has allowed us to learn the needs of the participants of the advertising market and gain valuable experience, allowing us to avoid many pitfalls and risks associated with advertising and promotional activities. In addition to drafting contracts for the provision of advertising and media services, as well as contracts necessary for the proper and safe implementation of advertising campaigns, we also draft rules and regulations for competitions and promotional lotteries as well as bonus sales programmes.

Protection of personal interest

We offer legal assistance through advice and consultations, written opinions, and the preparation of contracts and other documents. We represent clients in courts and before other entities.

Litigations

We offer legal assistance in civil and commercial matters, consisting in representing clients in litigations before common courts and the Supreme Court. We have experience in conducting court proceedings, in particular regarding the protection of personal rights, copyrights, publication of press corrections and matters related to current business activity, as well as labour law.

Artistic events, concerts and other mass events

We provide legal services related to the organization of artistic performances, concerts and other mass events. We support clients at the stage of planning a given event, through all formal issues, preparation of documents, contracts, as well as legal services on site and during the event. Based on our many years of experience in servicing the artistic and creative industries, we provide assistance in the organization and handling of non-standard and complex cases.

Company law, business law, foundations and associations

As part of cooperation with clients, we provide assistance in the proper fulfilment of formal requirements when starting business and, using many years of experience, we help to choose the most appropriate organizational and legal form for a specific type and scale of planned activity. In the case of companies, we assist in the proper regulation of internal relations between partners. In the course of conducting business activity, we advise and provide assistance in the proper fulfilment of the obligations arising from the Polish Code of Commercial Companies and Partnerships and the Act on Freedom of Economic Activity. Furthermore, we have extensive experience and offer services in the field of establishing foundations and associations and their subsequent servicing and assistance in fulfilling the obligations imposed on them by the law.

We offer consultancy in the field of personal data protection and handling business activity on the Internet, as well as private businesses of our clients. Today, the Internet not only offers many opportunities, but also involves new risks in terms of data protection security and all sorts of breaches, including violations of our clients’ personal rights, company’s good name, etc. We help create online stores and platforms, forms and tools used, for example, for advertising, sales, IT, educational purposes, organizing artistic events and implementing new technologies.
